Employment Green Cards

Employment Green Cards – Secure Permanent Residency Through Work

An Employment-Based Green Card (EB Green Card) allows foreign professionals and skilled workers to live and work permanently in the United States. At US Immigration Lawyers, we assist individuals and employers in navigating the complex green card process, ensuring smooth applications and approvals.

Types of Employment-Based Green Cards
  • EB-1 (Priority Workers)
For individuals with extraordinary ability in sciences, arts, education, business, or athletics, outstanding professors and researchers, and multinational executives or managers.

  • EB-2 (Advanced Degree Professionals & Exceptional Ability)
For professionals with an advanced degree (Master’s or higher) or those with exceptional ability in business, science, or the arts.

  • EB-3 (Skilled Workers, Professionals & Other Workers)
For skilled workers with at least two years of experience, professionals with a U.S. bachelor’s degree or equivalent, and unskilled workers performing jobs that lack U.S. workers.

  • EB-4 (Special Immigrants)
Includes religious workers, certain medical professionals, employees of U.S. foreign service posts, and other special categories.

  • EB-5 (Investor Green Card)
For investors who invest at least $800,000 in a U.S. business that creates jobs.

Employment Green Card Process
  1. Labor Certification (PERM) – If Required
For EB-2 and EB-3 applicants, the employer must obtain a PERM Labor Certification from the U.S. Department of Labor, proving no qualified U.S. workers are available.

  2. Employer Files Form I-140 (Immigrant Petition for Alien Worker)
The employer submits the I-140 petition to USCIS, demonstrating the applicant meets all eligibility criteria.

  3. Wait for Priority Date to Become Current
Based on visa availability, applicants may need to wait before proceeding with the final green card step.

  4. File Form I-485 (Adjustment of Status) or Consular Processing
If already in the U.S., the applicant files Form I-485 to adjust their status. If abroad, they attend a consular interview at a U.S. embassy or consulate.

  5. Receive the Green Card
Once approved, the applicant receives permanent residency and can legally live and work in the U.S.
